Description To lead on developing the Trust’s commercial activities:
- Delivery of the Trust's Vision through close working and liaison with clinical services and the Trust’s current and prospective commercial partners.
- Identifying, developing, and delivering commercial income and efficiency opportunities through the Commercial Development team and the wider Trust clinical and management teams.
- Developing and leadership of the Trust’s strategy for commercial activities, ensuring compliance with statutory regulation and relevant guidance issued by the Trust, Monitor, the Department of Health and other central government bodies and the European Union.
To be responsible for scrutinising the development of the detail of commercial issues, supervise progress and contract monitoring; and develop standardised methodologies and processes for all commercial activities – whether delivered by the department or by others.
To act as the Trust’s internal expert on procurement vehicles and contractual structures; for example, PFI / PPP, Procur21, Joint Ventures, Development Agreements and strategic partnerships.
To be responsible for the strategic direction, negotiation and management of all non-clinical income generating commercial contracts (excluding those within the remit of the Property Services Manager, e.g. University Leases)
To be responsible for the preparation of all business cases associated with commercial projects in accordance with the agreed programme, ensuring compliance with NHS, Private Finance Unit of Department of Health (PFU) & EU procurement guidance.
Manage the development, revisions and updates of the planning brief / output specifications for the projects, including for example: demand and financial projections, benchmarking, functional requirements, operational policies, schedules of accommodation, outline fact sheets, room data sheets and whole hospital policies.
Identify and work with all key stakeholders from across the Trust and wider health economy to ensure the necessary consultation takes place and that approvals are gained for the projects.
To be responsible for ensuring professional expert Commercial (Legal, Financial and Insurance) and Technical (Architectural, Civil and Structural, Mechanical & Electrical and Quantity Surveyor) advice is sought when required; and appointing and managing advisors
To be responsible for all aspects of the project management, from inception to delivery, of the commercial projects; including clinical engagement, facilitation, appropriate communication and marketing, preparation of documentation, and negotiation.
To be accountable for project governance, ensuring informed decisions are taken appropriately within authorised limits.
To establish, manage, and chair (if required) project specific task & finish steering groups / boards / working groups.
To take appropriate judgements as to when to escalate issues to the Director of Strategy, Director of Finance or Chief Executive, briefing as appropriate.
To input to specific projects outside the general remit of Commercial Development as appropriate.
Be responsible for the Trusts communication with the Department of Health; Procurement, Investment and Commercial Division (PICD) for those projects that are under their auspices ensuring that DH advice / requirements are appropriately incorporated into the Trust’s Business Cases.
To manage major clinical tenders.
